Assistant Counsel Provides legal services and counsel to the Cape Fear Valley Health System and its related entities (CFVHS) on various legal matters including interpretation and application of laws and regulations, as well as contractual relations and liability matters.The following is a summary of the major essential functions of this job. The incumbent may perform other duties, both major and minor, that are not mentioned below. In addition, specific functions may change from time to time:
Advises and counsels middle and senior levels of management on diverse issues of law that arise in business operations
Researches and prepares legal memoranda and opinions to apply technical legal knowledge to varying business situations and personnel issues
Drafts, negotiates, and reviews legal agreements, significant correspondence and other documents on behalf of CFVHS
Represents CFVHS before federal and state regulatory authorities with jurisdiction over CFVHS
Assists CFVHS with assuring compliance with all law and regulations governing its business, including preparation and timely submission of mandated regulatory filings
Provides client training on timely and relevant legal issues
Monitors legislative and regulatory proposals, evaluates such proposals, and assists CFVHS management with formulating CFVHS’s position of these matters
Negotiates settlements of disputes and administrative complaints
Researches and prepares legal memoranda concerning unusual questions having limited precedent and involving developing areas of the law or novel questions
Prepares reasoned opinions on moderately complex legal questions, prepares or advises on unusual contracts or filings
Other duties as assigned
The following qualifications, or equivalents, are the minimum requirements necessary to perform the essential functions of this job:
Juris Doctor from an accredited law school required
Licensed to practice law in North Carolina or must obtain License within 1 year of employment
3 years as a practicing attorney in a law firm or in-house position
Experience in health care industry, including preparation of contracts and transactional documents preferred
Effective oral and written communication skills
Strong problem-solving skills
Knowledge of health care industry
Ability to work well individually and as a team member
Work schedule in excess of 40 hours/week
