Associate General Counsel, Litigation & Risk
Do you have a law degree and extensive litigation experience in healthcare? As the Associate General Counsel for Litigation and Risk, you will be responsible for managing litigation and risk associated with insurance and incidents involving employees, independent contractors, and individuals in service across the company. You will provide legal and risk management advice to other corporate departments and leadership teams, and help develop systems and procedures aimed at promoting high-quality care for the individuals we serve.
This role is 100% remote and can be performed from anywhere in the U.S.
Responsibilities:
Select and manage outside defense counsel in professional and general liability matters, including medical malpractice, negligence, and personal injury claims and litigation; assist with discovery responses in suits; prepare a defense of small claim actions
Provide legal and risk management consultation to Operations, Legal, Quality Improvement, and the Executive team
Review critical incidents and corresponding internal investigations in the Company’s electronic incident management system to identify professional and general liability (PLGL) concerns
Report high risk incidents to the company’s PLGL insurance carrier as needed
Participate in mortality review and root cause analysis meetings
Identify trends in incidents leading to litigation and assist with the design of educational interventions to help reduce risk
In collaboration with Legal and Quality Improvement, provide leadership in the development and enhancement of systems, controls, and procedures that help enhance quality of care
Assist with conducting diligence of potential acquisitions and integrating acquired companies on risk management processes
Report key litigation and risk management initiatives to the Executive team
Provide legal guidance on responding to subpoenas, court orders, and other requests for information from various outside agencies
Assist with the litigation hold process
Qualifications:
Juris Doctorate Degree (JD) from a nationally accredited law school; admitted or eligible for the state bar
Seven to ten years of litigation experience in a healthcare setting; some management experience strongly preferred
Experience successfully managing outside counsel preferred
Ability to identify risk and propose alternative approaches to help mitigate risk
Ability to work successfully in a team environment
Strong communication, analytical, leadership, and management skills
